There is a theoretical proposition that I find increasingly true. Let me state it. You won't find anything about it in law textbooks.
Law (as a system) is a product and therefore an instrument of actual social conception. The main (unwritten) function of law (actual legal practice), is to protect the social conception, as it actually is, from non-conceptual changes. If the system of law fulfils this function, then law works. If the real social conception is based on a large-scale criminal foundation, systemic violations of written law, and crypto-fascism as the tools necessary to exercise power over people, then HER legal system protects all of this primarily in consequence, not eliminates it. And if it does, then the law is working properly and not not not working (!).
Law "can only afford" to remove and address those elements in society that are superfluous and expendable to its realistic conception as it currently exists. What the written law declares is not at all relevant. It is such a misleading advertisement for the people. Only the societal (conceptual) consequences of its enforcement are relevant. Hopefully it will somehow work in someone else's mind too, in relation to ALL those "legal solutions to the current situation".

The main function of law is (is supposed to be, in theory, which is seemingly or partially happening as and when and where), to watch over the application and observance of the laws and rules that society has formulated and set out as its creed and which it imposes on all its members in the interests of justice, order, functionality, equality of treatment and measurement, etc., but also to maintain the power of the ruling class, i.e. the social establishment, the "concept" and the wealth of the elites. What the written law declares and prescribes is of course overturned, circumvented, twisted, subverted in practice. The problem with the "systemic violation" of these rules is that this is different from case to case, erratic, distorted, and means de facto anarchy, which quickly turns the accompanying and actually pervasive oppression into tyranny, distortion, judicial evil, contrived lying processes, enslavement of the people, terror, plunging the nation into wars, misery, disease, and as a result of all this, all-round decline. ...

Mr. Šinágl,
I am sending you for your information and as an example the "JUDGMENT FOR COMPENSATION AND REMOVAL", what is the justice system in the Czech Republic like when someone is accused foully, just so that the police officers and prosecutors have some "excercise" without punishment. Ministry of Justice doesn't even bother to compensate this criminal act of the prosecutor.
This state, the SZ and the police, I dare say, is a communist-fascist state, a state where laws do not apply and where prosecutors often behave like the Gestapo - with impunity and will accuse anyone. The fact that it is not democratic has already been demonstrated many times. It is a consequence of the 1989 agreement between the Chartists and the Communists. It was not a "revolution" but a mutual agreement, the consequences of which are still being felt today.
A state where the criminal so-called 'Benes Decrees' are still part of the criminal code, where they are referred to in restitution judgments, where they are still 'proud' of them, and which has not been able to fully apologise for the evil it has done, where it does not even have the will or the interest, does not belong to the community of democratic EU countries.

Another frightening example is an article by Václav Budinský, a writer and chairman of the Society for the Rule of Law: Are we protecting whistleblowers enough? (LN 12.5.2022).
On 11.5.2022, I testified at the Beroun Police Station, as the accused, in the matter of the voluntary auction of my house. The bailiff is inventing more, unsubstantiated foreclosures - the file has perhaps about 500 items that it is not even possible to read it all?! I have just had another foreclosure imposed on me for non-fulfilment of a long-ago obligation. The Beroun District Court approves everything without checking the validity of the execution. The bailiff accepts new proposals from creditors.
I have paid 2 million crowns for damaging the "reputation" of public figures, 700,000 crowns to the state for "justice" (repeated, maximum fines of the bailiff), loss of my family home, damage to my health and it is still not enough. Apparently it will be enough when I am silenced, or not, when there is no place to take or steal. It's a war. Battles are part of it - even court battles.
Such is the price of free speech and the public's right to information in the Czech Republic. Not even the fascists dared to do that, without relativizing their crimes in the slightest. We live in a criminal, corruption-ridden state whose rottenness is covered by "democratic clothing". The question is how long will the citizens put up with it and how much more of it is the country able to bear and endure?
