1) Eavesdropping. Phone eavesdropping falls under the criminal arm of police investigation; also, to criminally charge a Member of Parliament or a Senator is permitted only after specific permission of the chamber this member belongs to. If judge issues permit to eavesdrop beforehand, he obviously presumes that such permission shall be granted, and in such case, he overreached not only his own jurisdiction, but also jurisdiction of judiciary.
2) Detention and home search. According to the police, Rath was taken into custody immediately after committing a crime. I would understand if such a crime was robbing a jewelry store or murder, but not taking a bribe. This case has all signs of a provocation aimed to bypass Rath’s Parliamentary immunity and, with a willing collaboration of Chairlady of a Parliament, to secure his arrest.
3) Custody. We do not know who gave an order for arrest, but the fact that instead of taking an arrestee to court, the Judge himself came to the police station to see him, points to unusual proceedings. I myself do not believe in the validity of alleged charges, but I can clearly imagine pressure aimed at the District Court of Usti nad Labem who shall decide if the custody is valid.
4) Inapropriate selection of State prosecutor and Court. Option to choice one of several State Prosecution Distrits, was used here to assign the case to State prosecutor Bradacova, so called media star, on whose judicial independence I wouldn’t bet a dime. If so called bribe was commited in Rudna u Prahy, the case belongs to the Prague District Prosecutor, and the prosecution should be carried out by the District Court Prague-West.
5) Manipulation with evidence during home search. The most troublesome exhibit was published photograph of a bag with a tag marking “machinegun model 58”. No evidence taken during a home search is never marked with the sing indicating contents, this doesn’t make any sense; in this particular case, someone was trying to manipulate public opinion and attempted to make out of alleged corrupt official also a would-be terrorist.
The Rath-gate is not the first case where a political struggle is conducted with the help of criminal means, we witnessed such conduct in the take-over of IPB (ODS client) and delivery it to CSOB (CSSD client), the case of Karel Srba (of whose guilt in some cases I am not convinced till today), or Report of Kubice with opposite effect. Public media in all those cases refused to analyze each and every one case and in an effect became biased spokesmen for involved politicians and their goons passing out propaganda information.
This clearly is another case why we should not resign on our own judgments and refuse to join the lynch mob fanned by biased journalists.
